1. Introduction

Welcome to Mercy44 Homes. By booking or staying at any of our properties, whether directly through our website or via a third-party platform such as Airbnb, you agree to be bound by the following Terms and Conditions. Please read them carefully before confirming your reservation.

These Terms apply to all guests, visitors, and any individuals present at a Mercy44 Homes property during a booking period.

2. Bookings & Reservations

2.1 Direct Bookings

Reservations made directly through the Mercy44 Homes website or WhatsApp are confirmed only upon receipt of full payment or an agreed deposit. A booking confirmation will be sent to the email address provided at the time of reservation.

2.2 Third-Party Platforms

Bookings made through Airbnb or any other third-party platform are subject to both Mercy44 Homes’ Terms and Conditions and the relevant platform’s own policies. In the event of a conflict, the third-party platform’s terms will govern where applicable.

2.3 Guest Responsibility

The guest who makes the booking (the Lead Guest) is responsible for ensuring that all members of their party are aware of and comply with these Terms and Conditions. The Lead Guest assumes full responsibility for the conduct of all guests during the stay.

3. Check-In & Check-Out

  • Check-in time:  2:00 PM — Early check-in may be available upon request and subject to availability
  • Check-out time: 10:00 AM — Late check-out may be available upon request and subject to availability
  • Self-check-in instructions will be provided to the Lead Guest before arrival
  • Failure to check out on time may result in an additional charge equivalent to one night’s stay

Please ensure all keys, access cards, and any provided items are returned or secured at checkout as instructed.

4. Maximum Occupancy

Each Mercy44 property has a maximum occupancy limit as stated in the listing. Guests may not exceed the stated maximum number of occupants at any time. Unauthorized guests found on the premises may result in immediate termination of the booking without refund.

5. Cancellation & Refund Policy

5.1 Flexible Policy

Mercy44 Homes operates a flexible cancellation policy for direct bookings:

  • Full refund if cancelled at least 24 hours before the scheduled check-in time
  • Cancellations made less than 24 hours before check-in are non-refundable
  • No refund will be issued for early departures or no-shows

5.2 Third-Party Bookings

Bookings made via Airbnb or other platforms are subject to the cancellation policy selected at the time of booking on that platform. Please refer to your booking confirmation for specific terms.

5.3 Mercy44 Cancellation

In the unlikely event that Mercy44 Homes must cancel a confirmed booking due to circumstances beyond our control (force majeure, property damage, or safety concerns), a full refund will be issued. We will make every effort to notify guests as early as possible and assist in finding alternative accommodation where possible.

6. House Rules

All guests are required to respect and adhere to the following house rules at all times. Violation of these rules may result in immediate termination of the booking without refund and, where applicable, additional charges.

6.1 No Parties or Events

Mercy44 Homes properties are strictly for private residential use. Parties, gatherings beyond the stated maximum occupancy, events, and any form of commercial or promotional activity are strictly prohibited without prior written consent from Mercy44 Homes management.

6.2 No Smoking Indoors

Smoking — including cigarettes, cigars, e-cigarettes, and any other smoking devices — is strictly prohibited inside all Mercy44 Homes properties. Designated outdoor areas may be used for smoking.

6.3 No Pets

Pets of any kind are not permitted at Mercy44 Homes properties unless explicitly agreed upon in writing prior to arrival. Unauthorised pets will result in immediate termination of the booking without refund, and any associated cleaning or damage costs will be charged to the Lead Guest.

6.4 Noise & Neighbours

Guests are expected to be considerate of neighbours and the surrounding community at all times. Excessive noise — particularly between 10:00 PM and 8:00 AM — is not permitted. Repeated noise complaints may result in termination of the booking without refund.

6.5 Property Care

Guests are expected to treat the property and all its furnishings, fixtures, and equipment with care. The property should be left in a reasonably clean and tidy condition at checkout. Excessive mess beyond normal use may attract an additional cleaning fee.

7. Damage & Liability

Guests are responsible for any damage caused to the property, its contents, or any communal areas during their stay. Mercy44 Homes reserves the right to charge the Lead Guest for any repair, replacement, or deep-cleaning costs resulting from damage beyond normal wear and tear.

Mercy44 Homes accepts no liability for loss, theft, or damage to guests’ personal belongings during their stay. Guests are advised to ensure they have adequate travel or personal property insurance.

Mercy44 Homes is not liable for any personal injury, illness, or accident occurring on the property, except were caused by proven negligence on the part of Mercy44 Homes.

8. Privacy & Data

Mercy44 Homes collects and processes personal information provided at the time of booking solely for the purpose of managing your reservation and communicating with you regarding your stay. We do not sell or share your personal data with third parties except where required by law or necessary to process your booking.

By making a direct booking through our website, you consent to our use of your personal data in accordance with this policy.

9. Right to Refuse or Terminate

Mercy44 Homes reserves the right to refuse a booking or terminate a st ay without refund if:

  • Any guest behaves in a manner that is threatening, abusive, or unlawful
  • Any house rule is repeatedly or seriously violated
  • The number of occupants exceeds the stated maximum
  • Unauthorised parties, events, or pets are found on the premises
  • The property is being used for any illegal purpose

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Malawi. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malawi.

11. Amendments

Mercy44 Homes reserves the right to update or amend these Terms and Conditions at any time. The most current version will always be published on our website. Continued use of our properties following any amendment constitutes acceptance of the revised Terms.
